1. Nature of the Service

ESProof provides software tooling to assist manufacturers in structuring product data into the format required by the Ecodesign for Sustainable Products Regulation (ESPR), Regulation (EU) 2024/1781. ESProof does not provide legal advice, regulatory compliance certification, or any guarantee of regulatory acceptance by EU authorities or market surveillance bodies.

2. Manufacturer Responsibility

The party submitting data through ESProof (hereinafter "the Manufacturer") is solely and fully responsible for:

• The accuracy, completeness, and truthfulness of all data entered into the platform.
• Ensuring that the generated Digital Product Passport meets applicable regulatory requirements before official use, submission, or publication.
• Verifying that sector-specific delegated acts and national implementation requirements are reflected correctly in the final document.
• Any consequences arising from the use of an inaccurate, incomplete, or non-compliant Digital Product Passport.

3. AI-Generated Content

Digital Product Passports generated by ESProof are produced using artificial intelligence (Claude, developed by Anthropic). AI-generated content may contain errors, omissions, or inaccuracies. Every generated DPP must be reviewed and verified by a qualified person at the Manufacturer before official use.

ESProof recommends that all generated documents are reviewed and approved by a qualified person at the Manufacturer before official use or publication. By reviewing and publishing a generated DPP, the Manufacturer assumes editorial responsibility for its content.

4. Regulatory Information

ESPR sector-specific delegated acts are still under development as of the date of this disclaimer. Compliance requirements, deadlines, and mandatory data fields may change. ESProof updates its requirements database periodically but does not guarantee that the requirements used at the time of generation reflect the most current regulatory state.

The Manufacturer is responsible for monitoring regulatory developments and ensuring ongoing compliance.

5. Limitation of Liability

To the maximum extent permitted by applicable law, ESProof and its founders shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, the ESProof platform or any generated document. This includes, without limitation, any regulatory penalties, fines, or enforcement actions resulting from the use of a ESProof-generated Digital Product Passport.

6. No Warranty

The ESProof platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of fitness for a particular regulatory purpose or uninterrupted availability.

1. Acceptance

By accessing or using ESProof (available at esproof.com), you agree to be bound by these Terms of Use. If you do not agree, you may not use the platform.

2. Permitted Use

ESProof is intended for use by businesses and professionals involved in the manufacture, import, or distribution of physical products subject to EU ESPR requirements. Use of the platform for any unlawful purpose is prohibited.

3. Account and Access

Access to certain features of ESProof may require registration. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Intellectual Property

The ESProof platform, including its software, design, and documentation, is the intellectual property of ESProof. Generated Digital Product Passports based on data submitted by the Manufacturer are owned by the Manufacturer. ESProof retains the right to use anonymised, aggregated data for platform improvement purposes.

5. Data Submitted by Users

By submitting product data through ESProof, you represent and warrant that you have the right to submit such data and that doing so does not violate any third-party rights or applicable law. You grant ESProof a limited licence to process and store submitted data solely for the purpose of providing the service.

6. Service Availability

ESProof does not guarantee uninterrupted access to the platform. Maintenance, updates, or technical issues may result in temporary unavailability. ESProof is not liable for any loss or inconvenience resulting from service interruptions.

7. Modifications

ESProof reserves the right to modify these Terms of Use at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

8. Governing Law

These Terms of Use are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the district of Noord-Nederland, the Netherlands.

9. Subscription and Payment

Access to paid features of ESProof is subject to a subscription plan chosen at the time of registration. Subscriptions are billed monthly. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. ESProof does not offer refunds for partial billing periods unless required by applicable law. ESProof reserves the right to change pricing upon 30 days' written notice.

Privacy Policy

1. Who We Are

ESProof is a software platform developed by Joren Veldhuis and Victor Jager. For questions about this privacy policy, contact us at info@esproof.com.

2. What Data We Collect

ESProof collects and stores the following data when a user generates a Digital Product Passport:

• Company name — as entered by the user in the form.
• Product name — as entered by the user in the form.
• Product sector — selected by the user (e.g. Electronics, Furniture).
• Form data — all product-related fields completed by the user.
• Generated DPP content — the AI-generated document based on submitted data.
• Timestamp — date and time of DPP generation.
• Internal/public type flag — whether the record is an internal or public DPP version.

We do not collect names, email addresses, or other personal data from individual users unless explicitly provided for support or contact purposes. We do not collect IP addresses, browser fingerprints, or usage analytics at this time.

3. How We Use This Data

The legal basis for processing submitted data is the performance of a contract with the Manufacturer (GDPR Article 6(1)(b)).

Submitted data is used exclusively to:

• Generate and host the Digital Product Passport for the submitting manufacturer.
• Provide access to previously generated DPPs via their unique URL.

We do not use submitted data for advertising, profiling, or sale to third parties.

4. Data Storage and Security

Data is stored in a secure cloud database (Supabase, hosted in the EU — West Ireland region). Access to the database is restricted and protected by service-level credentials. Data is not encrypted at rest beyond the protections provided by the hosting infrastructure.

We take reasonable technical measures to protect stored data, but cannot guarantee absolute security.

5. Data Retention

Generated DPPs and associated form data are stored for as long as the associated account is active or until the Manufacturer requests deletion. If you wish to have your data removed, contact us at info@esproof.com.

6. Third-Party Services

ESProof uses the following third-party services in the delivery of its platform:

• Anthropic (Claude API) — submitted product data is sent to Anthropic's API for DPP generation. Anthropic's data processing terms apply. Data submitted via API is not used to train Anthropic's models under their current API terms. Submission of product data to the Anthropic API constitutes a transfer of data to a third country (United States). This transfer is governed by Standard Contractual Clauses (SCCs) as provided under Anthropic's API Data Processing Addendum, in accordance with GDPR Article 46(2)(c).
• Supabase — cloud database hosting (EU region). Supabase's privacy policy applies to infrastructure-level data handling.
• Vercel — platform hosting. Vercel's privacy policy applies to request-level data handling.

7. Your Rights (GDPR)

If you are located in the European Economic Area, you have the following rights under the General Data Protection Regulation (GDPR):

• The right to access data we hold about you.
• The right to rectification of inaccurate data.
• The right to erasure ("right to be forgotten").
• The right to restrict processing.
• The right to data portability.
• The right to lodge a complaint with a supervisory authority. In the Netherlands, this is the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

8. Cookies

ESProof does not use tracking cookies or advertising cookies. No cookie consent banner is required at this time. This policy will be updated if cookie use changes.
